Millions of children in the United States are homeschooled. In fact, Home School Legal Defense Association (HSLDA) projects that this number will reach over 12 million by 2015. The United States Constitution does not have specific laws concerning education; each state governs education and has its own laws concerning homeschooling. So, if you’ve considered homeschooling your children, you will only have to learn the laws for your individual state.


Homeschooling laws vary from state to state. Each state has a mandate to provide an education for its students; many states delegate that authority to the state’s Board of Education. The state Board of Education wants to ensure that every child receives an adequate education. Because of this mandate, one Federal law was passed, Equal Education Opportunities Act of 1974. This law requires that no state can deny any child an education based on their race, color, sex, or national origin. In other words, every child within every state is guaranteed an education.


While states cannot deny a child an education, it is ultimately up to the parent to choose where that child will attend school — whether public school, private school, or homeschool. Public schools, and some private schools, are regulated by the state. However, since a large percentage of homeschool families do so for religious reasons, there are often few regulations for homeschools.


One state law that appears to be universal is the requirement for children to attend school in some fashion during set compulsory ages. These ages, however, may be different in each state. Some states require children to be in school from 5 to 17, others 7 to 16; it just depends on the state’s laws. To determine what your state’s compulsory ages are you can search the internet, or contact HSLDA.


Home School Legal Defense Association, National Home Education Network, and other websites on the Internet, list the homeschool laws for each state. If you choose to homeschool, it would be advantageous to learn your state’s laws. After you have begun to homeschool, if you move to another state, especially if you are a military family, you can go back to these sites to find the laws for the new state.


Military families often move several times throughout the length of a soldier’s career. Many are choosing to homeschool because it is one way to guarantee continuity in their children’s education. Rather than transferring a child from one school to another, often internationally, a military family that homeschools can continue their child’s education without fear of negative impact.


Choosing to homeschool is not always an easy decision to make. However, it is legal in each of the fifty states. You may have to register your intent to homeschool with your local board of education or you may have to turn in portfolios. Whatever your state requires, just remember that you are allowed by law to homeschool your child, and that there are places to turn if you have questions.

Michigan Homeschooling State Laws and Information

This is intended for general information. Check your state Education Department for further advice. Each state has its own general requirements for homeschoooling students. There are four categories of legal options for homeschooling. The four categories are: states requiring no notice, states with low regulation, moderate regulation and high regulation.

Many of the regulations include parental notification, test scores, professional evaluation of student progress and curriculum approval. Michigan homeschooling families shouldn’t be scared off by the general requirements for homeschooling. There may be some initial paperwork to handle but as long as the teaching parent can keep good records there shouldn’t be any fear of the state stepping in and ordering your child back to public school.

The states that have no requirements for homeschooling do not require the parents to initiate any contact to the state Dept. These states include Idaho, Texas, Oklahoma, Missouri, Illinois, Indiana, Michigan, Connecticut, New Jersey and the territories of Guam and Puerto Rico. Parents are not obligated to contact the school districts to notify them that they will be homeschooling their children.

States that have low general requirements for homeschooling require the parents to notify the school district that they are homeschooling their children and nothing else. These states include California, Nevada, Montana, Wyoming, Arizona, New Mexico, Nebraska, Kansas, Wisconsin, Kentucky, Mississippi, Alabama, Delaware, Washington D.C. and the territory of the Virgin Islands.

Moderately regulated states require parents to send notification, test scores and provide a professional evaluation of the student’s progress. The states in this category include Oregon, Colorado, South Dakota, Iowa, Arkansas, Louisiana, Tennessee, Ohio, Virginia, North Carolina, South Carolina, Georgia, Florida, Maryland and the territories of American Samoa and Northern Mariana Islands.

States with the highest regulations may be the most concerning to parents contemplating homeschooling. These states general requirements for homeschooling stipulate parents have to send notification or achievement test scores, provide professional evaluations of student progress as well as provide a written curriculum that needs to be approved by the state, teacher qualification of the parents and on some occasions visits by state officials to check the student’s progress. These states include Washington, Utah, North Dakota, Minnesota, West Virginia, Pennsylvania, New York, Vermont, Maine, Rhode Island and Massachusetts. These states have few requirements for the Kindergarten level but the regulations become stricter at each subsequent grade level.

A parent is considered competent to operate a homeschool if they follow the individual state’s regulations; they do not need to have teacher certification. The parents need to file a notice at their local school that they intend to homeschool in the low to highly regulated states. Those that fall within the medium to highly regulated states will also need to keep attendance records, file quarterly reports and a grade narrative for each of the subjects taught. Highly regulated states may require an annual assessment at the end of the school year. 

The general requirements for Michigan homeschooling and other states vary greatly from state to state. Parents should be well versed in the legal aspects of homeschooling before they decide to attempt it. Most parents will find that the red tape at the beginning is well worth it in the end.

Every parent dreams of giving their child an exceptional education. For many parents this means looking at the different schools within their home areas. For others this can mean looking at a suitable homeschooling program. While there are lots of different types of homeschooling programs that are available each state has its own set of rules regarding homeschooling. These homeschooling laws are worth checking out before you enroll your child in a home school program.

To find out what your local homeschooling laws are like it is best if you know some facts about your state’s policy towards homeschooling. This is due to the fact that some states seem to have no need for documentation from parents or homeschooling programs about their enrollment policies or the subjects that they teach.

When you look for this information on the internet you will find that there are four categories of homeschooling laws. These laws range from no legal requirements about homeschooling to very strict laws regarding homeschooling. At present there seems to be about 6 states where the homeschooling laws are very strict. On the other hand there are 10 states where there is no need for homeschooling laws.

These homeschooling laws are also found in the territories of the US. Since there are many different criteria that states have for homeschool studies there are times when as parents you will need to provide documentation. The documentation will include parental notification to the state about your child’s studying as a home school student.

For the states where the homeschooling laws are very strict the state requires more than a parental notification from the parents. The documents that you must produce are achievement test scores, the homeschool curriculum approved by the state, professional evaluation of your child’s educational progress.

You will also need teacher qualifications of you and your spouse as teachers for your children while they are engaged in homeschooling. Some states may require that state officials visit your home to inspect if the children are receiving a high education. These are just a few of the various documents and other facts that you need to be aware of regarding your state’s homeschooling laws.

Since each state has different rules regarding homeschooling it is a good idea if you can find information about the state laws for homeschooling. The main fact that you should keep in mind with state laws and homeschooling is that before your child becomes a home school student you might need to see what the homeschooling laws are.
